The Sena (UBT) claimed the Supreme Court had given them protection and if the Shinde-led Sena tries to take action against Uddhav faction MLAs, it would be contempt of court. Uddhav faction MLAs sat on the opposition benches with Maha Vikas Aghadi (MVA) MLAs and not on the treasury benches with the Sena MLAs who are in the ruling coalition with the BJP. Since the Shinde-led Sena had taken over the Shiv Sena’s party office in the legislature, Sena (UBT) MLAs on Monday held a meeting in the office of opposition leader in the legislative council Ambadas Danve.
Bharat Gogawale, chief whip of the Shinde-led Sena said, “Shiv Sena MLAs have been issued a whip for their presence during the session. This whip has been issued to all 55 MLAs. The SC has given instructions not to take action. But attending the session is not an action. It is the whip that all should be present in the House.”
Sena (UBT) MLA Sunil Prabhu said that they would issue their own whip for their MLAs. “We are going to issue the whip for asking MLAs to remain present. They (Shinde-led Sena) cannot issue a whip to us. The lawyers of the Shinde faction told the SC that no whip will be issued. If they continue to issue whips despite telling the court, we will go to SC again and tell the SC that they are in contempt of court. Lords of justice will give us justice,” Prabhu said.
Minister Shambhuraj Desai said they were the real Shiv Sena. “We are no longer a faction, we are now the real Shiv Sena. There are three sessions of the state legislature and on the first day, all MLAs are issued a whip to attend the session and take part in the proceedings. As part of this procedure, all MLAs have been given a whip. We have told the SC that if there is violation of any whip, we will not take any action against the MLAs till SC decides the case,” Desai said.
